Public contract-offer for the provision of services of the FlyMod online store LLC "FLYMOD"

This Public Offer Agreement (hereinafter referred to as the "Agreement") is an official offer of FLYMOD Limited Liability Company (hereinafter referred to as the "Seller") addressed to any individual or legal entity (hereinafter referred to as the "Buyer") to conclude a contract for the sale of goods remotely, on the terms and conditions set forth below.

1. General provisions

1.1 This Agreement is a public offer in accordance with Article 633 of the Civil Code of Ukraine.
1.2. The Agreement shall be deemed concluded from the moment the Seller receives the Buyer's acceptance (consent) on the terms of this Agreement, which is confirmed by the fact that the Buyer has placed an order on the Seller's website https://flymod.net (hereinafter referred to as the "Online Store").
1.3. The Seller reserves the right to amend this Agreement at any time without prior notice to the Buyer. Changes come into force from the moment they are published on the website of the online store.

2. The subject of the contract

2.1. The Seller undertakes to transfer to the Buyer the goods selected on the website of the online store, and the Buyer undertakes to pay and accept these goods in accordance with the terms of this Agreement.
2.2 The goods are sold in the assortment specified on the website of the online store at the time of ordering.

3. Ordering procedure

3.1. The Buyer independently places an order on the website of the Online Store, choosing the product, its quantity and other characteristics.
3.2. After placing the order, the Buyer receives confirmation from the Seller by e-mail or in another way.
3.3 The Seller has the right to refuse to process the order in case of unavailability of the goods or for other justified reasons.

4. Terms of payment

4.1 Payment for the goods is made by the Buyer in one of the following ways:

Cashless payment to the Seller's account under IBAN.
Payment by card online through payment systems integrated on the website of the online store.

4.2. The order is considered paid from the moment the funds are credited to the Seller's account.

5. Delivery of goods

5.1. Delivery of goods is carried out throughout Ukraine by means of postal services, such as "Nova Poshta" and others, which are available on the website of the online store.
5.2. Delivery time is up to 4 (four) business days from the date of order confirmation and payment.
5.3. The cost of delivery is paid by the Buyer according to the tariffs of the selected postal service.

6. Rights and obligations of the parties

6.1. The Seller undertakes to:

Provide the Buyer with accurate information about the goods, the terms of their purchase and delivery.
Ensure the transfer of goods that correspond to the description specified on the website of the online store.

6.2. The Buyer undertakes to:

To pay for and accept the ordered goods in a timely manner.
Provide the Seller with up-to-date contact information for delivery.

7. Return of goods

7.1. The buyer has the right to return the goods within 14 days from the date of receipt in accordance with the Law of Ukraine "On Consumer Protection".
7.2. The return of the goods is carried out at the expense of the Buyer, unless otherwise provided by the legislation of Ukraine.

8. Responsibility of the parties

8.1. The seller is responsible for the timely delivery of the goods within the terms of this Agreement, but is not responsible for delays caused by postal services.
8.2. In case of violation of the terms of payment or receipt of the goods by the Buyer, the Seller has the right to refuse further service to the Buyer.

9. Confidentiality

9.1. The Seller undertakes not to disclose the Buyer's personal information, except as provided by the legislation of Ukraine.
9.2. The Buyer's personal data is used solely for the purpose of fulfilling the order and improving the quality of service.

10. Final provisions

10.1 This Agreement is governed by the laws of Ukraine.
10.2. All disputes arising in connection with the execution of this Agreement shall be resolved through negotiations or in court in accordance with applicable law.
